Approving this ordinance will increase the franchise revenues by approximately $104k annually.

RES/ORD

WHEREAS, it is the intent of the City Council to protect the public health, safety and welfare; and

 

WHEREAS, pursuant to the laws of the State of Texas and the Charter of the City of Gonzales, the City Council has the power by Ordinance to grant, amend, renew and extend all franchises of public utilities of every Character operating within the City of Gonzales. 

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GONZALES, TEXAS:

Section 9.4 of the Texas Disposal System, Inc. Agreement is hereby amended as follows:

 

9.4              Contractor to Act as Collector - The Contractor shall submit monthly statements to each customer receiving commercial container service, including roll off container and compactors for services provided by the Contractor pursuant to Section 5 including those such accounts that are delinquent.  Billing will be in Arrears.  See Attachment “A” for rates.  Rates will be subject to an added 15% franchise fee which Contractor will remit to City quarterly. 

             

              Commercial carts, which are billed by the city will have a franchise fee of 12%.

 

              Residential billing by the city to residents will include a franchise fee of 10%.

             

              IN WITNESS WHEREOF, the City and the Contractor, each representing that its signatory hereto has full authority to bind it hereto, have executed this AMENDMENT on the date hereinafter referred.

 

All other Sections of the Agreement shall remain in effect.

 

This ordinance shall not become effective until after its publication in the newspaper as provided in Section 10.02 of the Charter of the City of Gonzales, Texas.
